Court Controls Your Restricted License Path
Your license was suspended yesterday and you need to drive to work Monday. In Maine, the Bureau of Motor Vehicles does not issue restricted licenses. The court that handled your case controls restricted license approval, and if your suspension includes a mandatory hard period, you cannot even file a petition until that period ends. First-offense OUI suspensions carry a mandatory 30-day hard suspension before any restricted license petition is viable.
This court-only pathway is a meaningful procedural difference from states where the DMV issues hardship licenses administratively. You petition the court, not the BMV. The court decides whether to grant restricted driving privileges, what purposes count as approved uses, and what hours you can drive. The BMV then enforces whatever the court orders. If the court denies your petition, no administrative appeal exists at the BMV level.

30 days
First-offense OUI suspensions in Maine carry a mandatory 30-day hard suspension before any restricted license petition is viable. Subsequent offenses carry longer mandatory periods. Filing a petition during the hard period triggers automatic denial.

What Maine Calls a Restricted License
Maine issues a Restricted License under 29-A M.R.S. § 2412 for most suspension triggers and an IID-specific Restricted License under § 2412-A for OUI cases. Both programs allow limited driving for approved purposes only. The court defines approved purposes when it grants the petition.
Typical approved purposes include work, school, medical appointments, and other court-approved essential travel. The court also defines time restrictions: hours necessary for approved purposes, not unlimited driving within a window. If your work shift is 7 a.m. to 3 p.m., your restricted license covers driving to and from work during those hours, not evening errands.
OUI-related restricted licenses require installation of an ignition interlock device for the entire restricted driving period. The Maine BMV maintains a list of approved IID vendors. The court order will specify IID installation as a condition of restricted driving privileges.
You cannot petition for a restricted license during the mandatory hard suspension period. Filing early triggers automatic denial. Wait until the hard period ends before filing.
Court Petition Requirements

Your petition must include proof of employment or essential need, statements supporting your hardship claim, and proof of SR-22 insurance if your suspension was OUI-related. The court evaluates whether restricted driving privileges serve a compelling need and whether granting them poses a public safety risk. Judges have discretion to deny petitions even when all documentation is submitted.
Processing time varies by court calendar. Some Maine courts schedule restricted license hearings within two weeks; others take 30 days or longer depending on docket backlog. If your petition is granted, the court issues an order specifying approved purposes, time restrictions, and any IID requirement. You take that order to the BMV to have your restricted license issued. The BMV does not evaluate your eligibility — it processes the court's order.
SR-22 Filing Anchors Insurance Coverage
OUI suspensions in Maine require SR-22 filing for 3 years after conviction. Your insurer files the SR-22 certificate electronically with the Maine BMV. The SR-22 proves continuous liability coverage at Maine's minimum limits: $50,000 bodily injury per person, $100,000 per accident, and $25,000 property damage. If your policy lapses or cancels, the carrier notifies the BMV and your restricted license is revoked immediately.
Not all carriers write SR-22 policies for restricted-license drivers. Bristol West, Dairyland, GEICO, Progressive, The General, and State Farm all write SR-22 coverage in Maine and accept restricted-license applicants. Monthly premiums for SR-22 coverage after OUI suspension typically range from $180 to $320 depending on age, vehicle, and prior claims history.
Non-owner SR-22 policies exist for drivers who do not own a vehicle but need SR-22 filing to maintain restricted driving privileges. Non-owner policies cover liability when you drive a borrowed or rented vehicle. They do not cover a household vehicle you drive regularly. If you live with someone who owns a car and you drive it frequently, standard SR-22 coverage on that vehicle is the correct path.
Maine Reinstatement Fee
$50
Maine's base reinstatement fee is $50 for most suspension types. OUI reinstatements carry higher fees and require completion of the Driver Education and Evaluation Program (DEEP) before reinstatement is approved. Verify current fees at maine.gov/sos/bmv.

Ignition Interlock Installation and Monitoring
Maine requires ignition interlock device installation for all OUI-related restricted licenses under 29-A M.R.S. § 2412-A. You choose an IID vendor from the BMV's approved list, schedule installation, and pay installation fees ranging from $75 to $150. Monthly monitoring fees run $60 to $100 depending on the vendor and your county.
The IID requires a breath sample before the vehicle starts and rolling retests while driving. Failing a retest, skipping a calibration appointment, or tampering with the device triggers a violation report sent directly to the court and the BMV. Violations can result in restricted license revocation and extension of your IID requirement period. Calibration appointments are mandatory every 30 to 60 days depending on vendor requirements.
Compare SR-22 Rates Before Filing
SR-22 premiums vary significantly across carriers even for identical driver profiles. GEICO, Progressive, and Dairyland often quote lower rates for restricted-license drivers in Maine than standard-tier carriers. Request quotes from at least three carriers before committing. Comparison tools that pull real-time quotes from multiple carriers save time and surface rate differences you would not discover calling individually.
Once you select a carrier and purchase coverage, the SR-22 filing happens electronically within 24 to 48 hours. The carrier submits the certificate to the Maine BMV. You receive a copy for your records. Bring the court order granting restricted driving privileges and proof of SR-22 filing to the BMV to have your restricted license issued. The BMV does not issue the restricted license until both the court order and SR-22 proof are on file.
